Strict Prohibitions: You may NOT:

  1. Resell, redistribute, sublicense, or share our products (free or paid).
  2. Modify, reverse-engineer, or create derivative works for commercial gain.
  3. Remove or alter any copyright, DRM (Digital Rights Management), or proprietary notices.
  4. AI & Scraping: Use automated bots, scrapers, or crawlers to extract our content for AI/ML model training or data mining without explicit written permission.

Violation of these terms will result in immediate termination of your license without refund and will be pursued to the fullest extent of the law.

4. Purchases, Subscriptions & SaaS (Recurring Billing)

4.1 Pricing and Taxes

All prices are listed in [USD , EUR, TL ] and are subject to change without notice. Depending on your jurisdiction, applicable sales tax, Value Added Tax (VAT), or Goods and Services Tax (GST) may be automatically calculated and added at checkout.

4.2 Payment Processing

We use Stripe as our secure payment gateway. We do not store, process, or have direct access to your full credit card data. By making a purchase, you agree to Stripe's Terms of Service.

4.3 SaaS & Auto-Renewal Subscriptions

If you enroll in a recurring subscription plan:

  • Auto-Renewal: Your subscription will automatically renew at the end of each billing cycle unless canceled prior to the renewal date.
  • Cancellation: You may cancel your subscription at any time via your account dashboard. Cancellations take effect at the end of the current paid billing cycle. No partial refunds are provided for unused time.
  • Price Adjustments: We will provide at least 30 days' advance notice of any subscription price increases.

5. Refund Policy & Consumer Waivers (Chargeback Protection)

5.1 Digital Goods — All Sales Final

Due to the immediate access and easily replicable nature of digital downloads (planners, e-books, templates), all sales of one-time digital products are final and non-refundable.

5.2 EU/UK Statutory Right of Withdrawal Waiver

In accordance with the EU Consumer Rights Directive (2011/83/EU) and equivalent UK laws: By initiating the download or accessing the digital content immediately upon purchase, you explicitly consent to the immediate performance of the contract and acknowledge that you irrevocably lose your 14-day statutory right of withdrawal/refund.

5.3 Chargebacks and Payment Disputes

Filing a chargeback, payment dispute, or fraud claim with your bank without first contacting us to resolve a technical issue is a direct violation of these Terms. We reserve the right to:

  1. Dispute fraudulent chargebacks using your IP address, purchase logs, and acceptance of this waiver.
  2. Permanently ban your account and IP from future purchases.

6. User Conduct & Security (CSP Compliance)

You agree to use the Site securely and legally. You shall not:

  • Upload malicious payloads, viruses, or Trojan horses.
  • Attempt to bypass our Content Security Policy (CSP), firewalls, or authentication measures.
  • Interfere with the server infrastructure or overload the Site via DDoS attacks.
  • Impersonate any person or entity associated with VibeVit.

7. AI-Assisted Content Disclaimer

We may occasionally utilize Artificial Intelligence (AI) tools to assist in research, formatting, or content generation. While all materials are reviewed for accuracy, AI-assisted content may contain errors. AI-generated text does not replace professional human advice.

8. Disclaimer of Warranties

THE SITE, DIGITAL PRODUCTS, SAAS TOOLS, AND ALL CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

  • Loss of profits, data, or business opportunities.
  • Health issues, personal injury, or psychological distress.

Maximum Liability Cap: In no event shall our total aggregate liability to you for all claims arising from your use of the Services exceed the total amount you actually paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

10. Dispute Resolution & Class Action Waiver

10.1 Mandatory Informal Negotiation

10.2 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES WITH US STRICTLY ON AN INDIVIDUAL BASIS. You expressly waive any right to participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding.

10.3 Governing Law & Jurisdiction

  • Severability: If any provision of these Terms is deemed invalid or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will remain in full force.
  • Entire Agreement: These Terms, alongside our Privacy Policy, constitute the entire agreement between you and us, superseding any prior agreements.
  • Language Supremacy: These Terms are drafted in English. If they are translated into any other language (e.g., Spanish, Turkish) for convenience, the English version shall strictly prevail in the event of legal conflict.
